Terms of sale

For the purchase of photographs within a gallery · Last updated: 2 September 2026

1. Who is selling to you

The seller is the photographer or studio who owns the gallery, not FotoHook.

They set the prices, hold the rights to the photographs, issue the invoice and are responsible for the sale. Their full identification details (name or company name, tax ID, address and contact details) are available within the gallery itself, and we will provide them if you request them at hola@fotohook.com.

APLICACIONES SAAS IBÉRICA, S.L. (Tax ID B93773620), owner of FotoHook, provides the technical intermediation service: it hosts the gallery, manages the shopping cart and connects to the payment gateway configured by the photographer. It is not a party to the sales contract and does not receive any commission on it.

2. What you are buying

A digital file of the photograph in high resolution and without a watermark, together with a personal, non-commercial use licence: you can download it, print it for yourself and share it within your private circle. You may not resell it, transfer it to third parties for commercial exploitation, or use it for advertising or commercial purposes without the photographer's written authorisation. Copyright remains with the photographer.

3. Prices

Prices are shown in euros and include applicable taxes. As this is a digital product, there are no delivery charges. Before confirming your order you will always see a breakdown showing the subtotal, any discounts applied and the total amount you are going to pay.

4. How to buy

  1. Add the photographs to the cart from the gallery.
  2. Review the summary: photos, quantities, discounts and total.
  3. Accept these terms and, where applicable, the waiver of the right of withdrawal (section 6).
  4. Click the "Order with obligation to pay" button: at that point the order is finalised and the obligation to pay arises.
  5. Complete payment on the gateway and receive order confirmation.

If you notice an error when entering your details, you can correct it at any step before confirmation by editing the cart.

5. Payment and delivery

Payment is made by card through Stripe or Redsys' virtual POS (TPV virtual), depending on what the photographer has configured. FotoHook does not store your card details.

Delivery is immediate: once payment is confirmed, the download becomes available under "My orders" in your private area. The download link has a limited validity period for security reasons; if it expires, you can request a new one from the photographer or contact us.

6. Right of withdrawal

As this is digital content not supplied on a tangible medium whose performance begins immediately, there is no right of withdrawal once the download has started, provided you gave your prior express consent and acknowledged this loss beforehand (art. 103.m of Royal Legislative Decree 1/2007, the TRLGDCU, the Spanish Consumer Protection Act). That is why you must expressly tick the relevant box before paying.

All the information about withdrawal, including the official withdrawal form, can be found on the right of withdrawal page.

7. Non-conformity and guarantee

If the file does not match what you purchased, is damaged, cannot be downloaded, or does not meet the advertised quality, you are entitled to have it corrected at no cost. The seller is liable for any lack of conformity of the digital content for two years from its supply (art. 120 TRLGDCU). Contact the photographer or write to us at hola@fotohook.com and we will help you resolve it.

8. Invoicing

The invoice is issued by the photographer, who is the seller. You can request it directly from them; if you do not receive a response, write to us and we will forward your request.

9. Complaints and dispute resolution

You can direct your complaints to the photographer or to hola@fotohook.com. As a consumer, you can also use the European online dispute resolution platform (EU Regulation 524/2013) and the consumer affairs bodies of your region (comunidad autónoma).

10. Data protection

The data you provide to make a purchase is processed in accordance with the Privacy policy. The controller of your data as a buyer is the photographer who owns the gallery; FotoHook acts as data processor.

11. Governing law

These terms are governed by Spanish law. As a consumer, you may bring proceedings before the courts of your domicile, and you retain all the rights granted to you by consumer protection law, which cannot be limited by these terms.
