1. Who we are

In compliance with article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE, the Spanish E-Commerce Act), below are the identification details of the owner of this website:

2. Purpose and scope

This legal notice governs access to and use of the website fotohook.com and the FotoHook platform (hereinafter, "the Platform"). Accessing the Platform implies full and unreserved acceptance of these terms from the moment of access.

Certain services are also governed by their own specific terms: the Terms of use and service agreement for photographers who subscribe to the service, and the Terms of sale for the purchase of photographs within a gallery.

3. What FotoHook is and its role

FotoHook is a technology platform that allows photographers and professional studios to create private galleries, deliver photographs to their clients, sell them and manage school class composites ("orlas").

Each registered photographer or studio is solely responsible for the content they publish, the photographs they upload, the prices they set and the relationship with their own clients. FotoHook acts as a provider of an intermediation and data hosting service under articles 13 to 17 of the LSSI-CE, without intervening in or reviewing gallery content in advance.

4. Intellectual and industrial property

Photographs. All photographs published on the Platform are the property of the photographers who uploaded them, or of whoever they indicate, in accordance with the Royal Legislative Decree 1/1996 approving the Spanish Intellectual Property Act. Their reproduction, distribution, public communication or transformation without the express authorisation of the rights holder is expressly prohibited. Purchasing a photograph grants a personal, non-commercial licence to use it, unless the photographer states otherwise.

Platform. The software, design, navigation structure, source code, logos, trademarks and other elements of FotoHook are owned by APLICACIONES SAAS IBÉRICA, S.L. or its licensors, and are protected by Spanish and international intellectual and industrial property law. Their use does not grant the user any rights over them.

5. Correct use of the Platform

The user agrees to use the Platform in accordance with the law and these terms, and in particular to:

• Not attempt to access galleries, codes or accounts for which they do not have authorisation.
• Not download, copy, resell or distribute photographs beyond the authorised use.
• Not use automated means (scraping, bots, mass downloaders) to extract content.
• Not upload unlawful or offensive content, content that infringes third-party rights, or content that includes the image of people without their consent.
• Not introduce malicious code or carry out actions that could damage or overload the Platform.

Failure to comply with these obligations may result in the immediate suspension of access, without prejudice to any legal action that may be applicable.

6. Unlawful content and takedown

If you find unlawful content on the Platform, content that infringes your rights, or content that includes your image without your consent, write to us at hola@fotohook.com, indicating the link or gallery affected and the reason. We will remove or block access to the content with the utmost diligence once we become effectively aware of it, in accordance with article 16 of the LSSI-CE.

7. Disclaimer of liability

FotoHook is not liable for content published by photographers or for the contractual relationships between photographers and their clients. Nor does it guarantee uninterrupted availability of the service, although it takes reasonable technical measures to keep it running and to minimise the effects of any interruptions. It is not liable for damage arising from improper use of the Platform by the user, nor for the loss of credentials for reasons outside FotoHook's control.

8. Links to other sites

The Platform may contain links to third-party sites. FotoHook does not control and assumes no liability for their content, policies or practices. The inclusion of a link does not imply any relationship, endorsement or oversight.

9. Data protection and cookies

The processing of personal data is governed by the Privacy policy and the use of cookies by the Cookie policy, both of which form an integral part of this legal notice.

10. Changes

FotoHook may amend this legal notice to adapt it to regulatory, technical or service changes. The applicable version is the one published at any given time, with the update date shown at the top.

11. Governing law and jurisdiction

These terms are governed by Spanish law. Where the user has the status of a consumer, the courts of their domicile will have jurisdiction. In all other cases, and unless mandatory law provides otherwise, the parties submit to the courts of Granada.
