If you are a consumer, the law allows you to withdraw from a distance contract within 14 calendar days, without having to justify your decision and without penalty (art. 102 of the consolidated text of the Spanish General Consumer Protection Act, TRLGDCU, approved by Royal Legislative Decree 1/2007).
For services and digital content, the period starts running from the conclusion of the contract.
The right of withdrawal does not apply to downloaded photographs.
This is digital content that is not supplied on a tangible medium and whose performance begins immediately. Before completing payment you must give your prior express consent for the download to start immediately and acknowledge that, by doing so, you lose your right of withdrawal (art. 103.m TRLGDCU). If you do not tick that box, the purchase cannot be completed.
This does not affect your rights if the file delivered does not match what you purchased, is damaged or cannot be downloaded: in that case, contact the photographer or us and we will resolve it.
For a FotoHook subscription, the right of withdrawal does apply when the person subscribing has the status of a consumer. You have 14 calendar days from the date of subscription. If you have already used the service during that period, you may be charged an amount proportional to the service actually provided (art. 108.3 TRLGDCU). Regardless of this, you can cancel your subscription at any time from your dashboard, without penalty and with effect at the end of the period already paid.
You simply need to notify us of your decision in an unambiguous statement before the deadline expires, by email to hola@fotohook.com or by post to APLICACIONES SAAS IBÉRICA, S.L., Avenida Cañada de los Fenicios, Aldea 5, Casa 24, 18150 Gójar (Granada). You may use the model form below, although it is not compulsory.
We will refund any payments received without undue delay and, in any event, within 14 calendar days of the date on which you inform us of your decision, using the same payment method you used, at no extra cost to you.
Annex B of the TRLGDCU (the Spanish Consumer Protection Act). You only need to complete and send it if you wish to withdraw from the contract.
